VOLUNTEER WAIVER AND RELEASE OF LIABILITY

In consideration of my participation as a volunteer in activities (each, an “Activity”) of Paddle Out Plastic Co., a California nonprofit public benefit corporation (the “Organization”), I understand, certify and agree to the following Volunteer Waiver and Release of Liability (“Release of Liability”) for myself and my successors, heirs, assigns, executors, and administrators, and for any person for whom I am signing as parent or legal guardian.

1. Risks Associated with Participating in an Activity. I understand that there are potential risks and hazards associated with participating in any Activity and that these risks could result in personal injury, illness, death, and property damage or loss, which may arise from my own actions or from the actions of others. Depending on the type of Activity I am volunteering to do, these risks could include capsizing or falling into deep and/or cold water; navigating waves and swells, and the wake of motorized watercraft; stepping onto slippery or muddy surfaces; running into or aground on natural and man-made objects; coming into contact with waterborne trash that may be pointy, sharp, unsanitary or otherwise hazardous or harmful; interactions with hostile individuals; and exposure to illness from human contact. I understand that this is not a complete list of all the risks (all of these risks, taken together with other predictable and difficult to predict risks not identified in this paragraph, are sometimes referred to collectively in this Release of Liability as the “Risks”).

2. Acknowledgement and Assumption of the Risks. I have voluntarily chosen to participate in an Activity, and I knowingly and voluntarily assume and accept all of the Risks of participating in the Activity and any resulting injury, illness, death, property damage or loss, expenses and financial obligations, loss of privacy, loss of reputation, and all other injuries and other consequences, whether known or unknown, whether foreseen or unforeseeable, and wherever incurred, regardless of what or who was the cause.

3. Release of Liability; Covenant Not to Sue; Indemnity. I hereby voluntarily release and discharge from all liability, and promise not to sue, the Organization, any sponsor of or partner in any Activity, any permitting or participating government entities or agencies, and the Organization’s officers, directors, agents, volunteers, representatives, insurers, independent contractors and/or employees (collectively the “Released Parties”) from any and all actions, demands, damages, expenses, attorney fees and claims and/or counterclaims of any kind or nature, whether known or unknown, including but not limited to any claims of negligence (passive or active) or claims arising from tort, contract, or otherwise, arising out of or in any way connected with my participation in any Activity, including travel to, from, and during the Activity, and including any accident or injury or illness to me and the costs of medical services, which I, or my heirs, executors, administrators or assigns, may have or might in the future have against any Released Parties. I also hereby voluntarily agree to indemnify and hold harmless the Released Parties from any and all actions, demands, damages, expenses, attorney fees and claims and/or counterclaims of any kind or nature, whether known or unknown, including but not limited to any claims of negligence, arising out of or in any way connected with my participation in any Activity that any person had, now has, may have or might in the future have against the Released Parties. FOR THE AVOIDANCE OF DOUBT, MY INTENT IN THIS RELEASE OF LIABILITY IS TO EXEMPT AND RELEASE ALL OF THE RELEASED PARTIES FROM ALL LIABILITY AND RESPONSIBILITY FOR PERSONAL INJURY, ILLNESS, DEATH, AND PROPERTY DAMAGE AND LOSS ARISING FROM THE ACTIONS OR INACTIONS OF THE RELEASED PARTIES, WHETHER PASSIVE OR ACTIVE.

In this regard, I acknowledge and agree that this Release of Liability is intended to be a general release of and bar to all claims arising out of or attributable to any Activity, including claims unknown to me, or which I do not suspect to exist at this time. I expressly, knowingly, and intentionally waive, for myself and for the Releasing Parties, any and all rights, benefits, and protections of California Civil Code Section 1542, which provides:

“A GENERAL RELEASE DOES NOT EXTEND TO CLAIMS THAT THE CREDITOR OR RELEASING PARTY DOES NOT KNOW OR SUSPECT TO EXIST IN HIS OR HER FAVOR AT THE TIME OF EXECUTING THE RELEASE AND THAT, IF KNOWN BY HIM OR HER, WOULD HAVE MATERIALLY AFFECTED HIS OR HER SETTLEMENT WITH THE DEBTOR OR RELEASED PARTY.”

4. Agreements Concerning Participation. I agree that my participation in any Activity is strictly voluntary, and I am not entitled to any compensation or benefit (monetary or nonmonetary) from the Organization or any sponsor of the Activity. I understand that the Organization may terminate my participation in any Activity at any time, for any or no reason. I am solely responsible for my own safety and wellbeing during my participation in any Activity and will undertake the Activity using reasonable care and caution to the best of my ability. During water Activities, I will wear or carry at all times while on the water a legally compliant personal flotation device (PFD). I certify that I have no medical or physical condition which could interfere with my safety or the safety of others while I am participating in an Activity, or else I agree to be responsible for the cost of all damage or loss that may arise, directly or indirectly, by any such condition. If the Activity involves paddling or other water activity, I certify that I know how to swim.

5. Use of Name and Likeness. In consideration of my participation in the Program, I grant and convey to Organization the right to use in Organization’s digital, audio, and print promotional, news and information reporting, fundraising, educational, and other communications any and all photographs, images, videos or audio recordings of me or my likeness or voice that are taken or obtained during my participation in any Activity, whether by the Organization, an Organization volunteer, local media agencies, or an observer of any Activity. This right to use is and shall be worldwide, irrevocable, in perpetuity, and without further payment or consideration, and I agree to release and hold harmless the Organization for any and all claims in connection with said creation and use.

6. General Provisions. I understand that this Release of Liability will be binding on me each time I voluntarily participate in any Activity of the Organization, and waive any necessity of providing a new waiver each time I volunteer. I understand and agree that this Release of Liability may be executed and delivered by electronic signature, including but not limited to email, PDF, or digital signature platforms. Any electronic signature is intended to authenticate this writing and shall have the same legal validity, force, and effect as a manually executed, wet-ink signature. If any provision of this Release of Liability is found to be unenforceable for any reason, the other terms remain effective. This Release of Liability will be governed by California law and any legal action, suit, or proceeding arising out of or relating to this Release of Liability must be brought and enforced exclusively in the State or Federal courts located in Los Angeles County, California. I acknowledge that the Released Parties are not joint venturers or partners with respect to any Activity for which I am volunteering.
